اقترحت مسودة الدستور الجديد في المادة 12 استمرار مؤسسات المجلس الدستوري ومحكمة العدل السامية والمجلس الإسلامي الأعلى والمجلس الاقتصادي والاجتماعي في العمل طبقا للنصوص المعمول بها، قبل إصدار الدستور الجديد.

 وحسب المادة 12 من المسودة، فإن هذه المؤسسات تستمر في عملها حتى إصدار النصوص النظامية التي تعنيها أو تعني المؤسسات التي تحل محلها.
